1. This website is operated by Bupa (Asia) Limited ("Bupa", "we", "our", "us"). Bupa grants you a royalty-free, world-wide, revocable license to use and access this website in accordance with these terms and conditions of use ("Terms of Use").

Governing Law and Jurisdiction

17. These Terms of Use are governed by and construed in accordance with Laws of Hong Kong. Any disputes arising from these Terms of Use shall be subject to the exclusive jurisdiction of the Hong Kong Courts.

18. If any part of this notice and disclaimer is deemed unlawful, void or for any reason unenforceable then that part will be deemed severable and will not affect the validity and enforceability of the remaining parts.

19. If Bupa does not act in relation to a breach of these Terms of Use by you, this does not waive Bupa's right to take action with respect of similar breaches in the future.

20. All rights not expressly granted herein are reserved by Bupa.

21. In the event of any inconsistency between the English and Chinese versions of these Terms of Use, the English version shall prevail.

Supplementary Terms and Conditions of Third-Party Communication Channels

This Supplementary Terms and Conditions of Third-Party Communication Channels (the “Supplementary Terms and Conditions”) applies once you use third party communication channels to communicate with Bupa (Asia) Limited and its affiliates and related companies ("Bupa", "we", "our", "us"), you shall be deemed to have read, understood and agreed to all of the Supplementary Terms and Conditions. The Privacy Policy (“Privacy Policy”) is incorporated into and made part of these Communication Channels Terms and Conditions. You also acknowledge that you have read and understood the terms of the Privacy Notice and that you agree with it.

If you do not agree to this Supplementary Terms and Conditions, you must not use third-party communication channels to communicate with us.

This Supplementary Terms and Conditions applies in conjunction with the Terms of Use contained herein on this webpage. If there is any inconsistency or conflict between the Terms of Use and this Supplementary Terms and Conditions, the terms of this Supplementary Terms and Conditions shall prevail.

Agreement

1. Third-party communication channels include but are not limited to WhatsApp Messenger, Facebook, Instagram and LinkedIn. Bupa reserves the right at any time to modify or discontinue, temporarily or permanently, any third-party communication channel or any part thereof with or without notice. You agree that Bupa shall not be liable to you or to any third party for any modification, suspension or discontinuance of any third-party communication channel or any part thereof.

2. The use of third-party communication channels is subject to the privacy policies and terms of service of the relevant service providers of the third-party communication channels. You acknowledge that these channels may not be available for use at all times, and may be subject to interruption, failure of hardware or software, errors, transmission blackout, delayed transmission due to internet traffic or incorrect data transmission due to the public nature of the internet, market volume or volatility, system failure or upgrades or maintenance or for other reasons. To the maximum extent permitted by applicable law, Bupa shall not be liable for any failure to carry out your online requests, or any data breach or leakage, or any use of information by any third-party communication channel, or any errors, omissions, damages or losses, which are attributable, wholly or in part, to any causes beyond the control of Bupa including but not limited to any technical malfunction or failure. To the maximum extent permitted by applicable law, under no circumstances shall Bupa be responsible to you for any direct, indirect or consequential losses arising from or in connection with the carrying out or not carrying out of your online requests.

3. You agree that you will not use third-party communication channels to communicate with Bupa in any way that is unlawful or infringes the rights of others.

4. All service information and materials provided by Bupa through third-party communication channels are subject to relevant terms and conditions. In case of a conflict between any particular term or condition with this Supplementary Terms and Conditions and the Terms of Use herein, to the largest extent permitted by applicable law, the term and condition that renders the most protection to Bupa shall prevail.

5. All information provided by Bupa is for reference only and intended for use in Hong Kong only.

6. You may use Bupa’s information and materials contained in third-party communication channels for your personal, non-commercial use. You may not amend, alter, make addition to or deletion of the information and materials or use them for any other purposes including public display of the same.

7. You agree to prevent any unauthorised copying and / or transferring of the information and materials.

8. If you receive a message from us in error, please notify us immediately and delete the message from your device. You are not authorised to copy, forward, disclose, retain or use any part of it.

WhatsApp Messenger

9. If you choose to chat with us on WhatsApp messenger, you acknowledge that we may use WhatsApp to send you information or administrative message regarding your medical insurance scheme. You may also use to access the following services from us through WhatsApp for: (a) general information on products and services of Bupa; (b) live chat service with Bupa’s customer service representatives (“Agents”); and (c) subject to your consent, direct marketing information on Bupa products and services.

10. For live chat enquiries on WhatsApp Messenger, it is required to provide us with your contact information, membership number and certain personal information for verification and follow-up purposes. You accept and acknowledge that any communications with our Agents and received by you pertaining to your instructions may contain personal information and/or information of your medical insurance scheme, and we shall not be responsible or liable to you for any possible release, loss or interception of such personal information and/or information.

11. Your live chat conversation with our Agents may be recorded for quality control and dispute handling purposes. You acknowledge and consent to the recording of such conversation for the said purposes. You agree that the recorded communications remain our property. You also agree that you will not challenge the validity, admissibility or enforceability of the recorded conversations on the basis that they are in electronic form.

12. Our Privacy Notice, which is available at https://www.bupa.com.hk/en/privacy, governs any personal information you provide to us. By communicating with us on WhatsApp, you confirm that you have read and understood the Privacy Notice. You have also brought the Privacy Notice to the attention of any the insured persons (or their guardians if applicable) and confirmed their understanding and agreement to it. You consent to the transfer of your personal information within or outside of Hong Kong for the purposes and to the types of transferees as set out in the Privacy Notice. You understood the Privacy Notice’s effect in respect of personal information collected or held by Bupa, including the use, storage, processing, transfer, disclosure and/ or sharing of part of or all of your personal information within the Group Companies in accordance with the Privacy Notice. 13. Please refrain from revealing any sensitive personal information, financial account information, passwords and other credentials with us over third-party communication channels. We also remind you not to share such information with us and to keep such information confidential and your device secure. Sharing of such information is at your own risk.

14. All information and conversations (including but not limited to all texts and images) you provide will be analysed to improve the accuracy and quality of our service.
